January 2025 –
Currently in the 8th circuit, Plaintiff argues that tribal governments have NO jurisdiction over nonmembers who live off the reservation in divorce cases. Hundreds of tribes have joined in amicus briefs against the Plaintiff. Nevertheless, the ICWA clearly states that there is NO ICWA jurisdiction over custody cases within a divorce, whether a parent is a tribal member or not.
